Below we will give you information on the manner in which we process data of our customers and of the users or our websites and apps for mobile devices (hereinafter referred to as "TUI websites").
TUI fly is a protected brand name of TUI AIRLINES BELGIUM NV (hereinafter referred to as “TUI”), which is responsible for the processing of your personal data.
We will process your data with the utmost care and guarantee that each processing of data meets the applicable laws and regulations (e.g. the Belgian Act of 8 December 1992 on the protection of privacy in relation to the processing of personal data (hereinafter referred to as the "Privacy Act") and any other applicable regulation).
a. Your personal data
Within the context of our services and the sale of our products, and whenever you make contact with us, we will record your personal data, e.g. your name, address, e-mail address, telephone number, your personal preferences and interests. If you make a booking, we may ask you for additional specific data that may be of interest for your trip, such as names and contact details of persons who stay at home.
b. How do we process your personal data?
If you booked a travel product or service with us, for instance a flight or any other form of transport, holiday or insurance, it is possible that we will disclose and process your personal data outside Belgium or the European Economic Area (EEA) in order to be able to perform our agreement with you. For instance, we have to forward your personal data to our suppliers who will deliver the actual services/products you booked with us (e.g. the hotel owner). If you travel abroad, the public authorities at your place of departure and arrival may require you to provide your personal data, who may be processed within the framework of border control or for immigration, safety, antiterrorism and other purposes deemed appropriate. The precise data that must be provided may differ for each destination. We wish to point out that the supervision of data protection outside the EEA may not be subject to the same strict rules as in our country.
We may also forward your personal data to a. companies in which TUI has a direct or indirect shareholders’ interest or which have a direct or indirect shareholders’ interest in TUI, b. companies acting on our behalf as data processor within the meaning of the Privacy Act, c. public authorities in Belgium and abroad in order to meet our legal obligations or as a courtesy to them.
The processing referred to under § 1 of this clause takes place for the following purposes: administration, customer service, relationship management, quality management, company and business management, reorganisation/restructuring of our company, risk assessment, safety, fraud and crime prevention/detection, control, research and analysis, marketing, profiling of purchasing preferences and trends among customers, product and service development, settlement of disputes, credit control and debt collection.
TUI may use your e-mail address for the purpose of Custom Audience Targeting via Facebook. TUI creates a custom audience by uploading e-mail address of its customers in an advertising tool. Subsequently, this group can be linked to specific Facebook campaigns: only these Facebook users will view the campaign.
In addition, TUI links your e-mail address to Google Customer Match in order to be able to better adjust our communication to your personal choices with online tools such as Search Engine Advertising (SEA) and Facebook.
Your personal data will allow us to contact you from time to time and/or provide you (directly or indirectly) with information about promotions for our services (or services offered by other entities of the TUI group), new products, events or contests organised by us. We can adjust the information we send or make available to you, so that you will receive personalised information.
When you make a booking, we assume that you agree to us sending you publicity and direct marketing material via e-mail/text messages or ordinary mail for the purposes indicated under § 1 of this article.
We may disclose the personal data provided by you to our commercial partners in the travel industry for the promotion of their related travel services. TUI will never forward your personal data to persons or companies that are not part of the TUI Group for other commercial purposes without your consent.
c. Your rights
You are at all times entitled to have access to these data, correct them or object to their use free if charge. You can address your written request in this respect, accompanied by a copy or your identity card, to TUI at the above-mentioned address. We will comply with your request within 45 days.
The provision of electronic services is important to us. If you subscribe to an (electronic) newsletter, you give us and our partners permission to use your e-mail address to send you the (electronic) newsletter as well as other information, such as promotions. You can exercise your right to object to direct marketing by clicking to confirm that you no longer wish to be contacted by e-mail upon receipt of a commercial message.
Only authorised persons have access to the data that are relevant for the performance of their services. TUI has taken the required technical and organisational measures in order to guarantee the confidentiality of the data provided by you. TUI guarantees that in case of misuse of your personal data caused by proven failures of our protection devices, we will assume our responsibility and pay a compensation for any losses you may have incurred as a direct result of these failures.
